Halibut Charter IFQ plan treading water –Hogarth asks NPFMC to confirm position A stalled plan to establish individual catch limits for halibut charter boats might be headed back to the drawing board -- or at least a fresh round of hot debate. Bill Hogarth, a top fisheries regulator with the U.S. Department of Commerce in Washington, D.C., has asked the North Pacific Fishery Management Council to "confirm its support" for the charter boat plan. Status of NMFS' response to Judge Alsup’s order to designate Critical Habitat for the northern right whale in the Pacific Ocean By ruling dated June 14, 2005, U.S. District Court Judge William Alsup remanded to the National Marine Fisheries Service (NMFS) the matter of revising critical habitat for the northern right whale in the Pacific Ocean. The remand includes orders for NMFS to publish a conclusive determination by October 28, 2005 by either proposing designation of an area in the North Pacific ocean as critical habitat for right whales or by explaining why such designation should not occur due to more paramount statutory considerations.

Clock is ticking on ban on mixing zones in fish spawning streams The Dept. of Environmental Conservation (DEC) was scheduled to announce its decision last November - but since then there has not been a peep or a leak about the outcome. The clock is ticking, however. DEC spokesperson Nancy Sonafrank said state "staleness" laws dictate that a decision on any proposed law changes must be made by one year of the last public notice. For DEC and mixing zones, that date is September 1. Other projects include rebuilding the city's existing harbor and creating a new marina at the head of Passage Canal. This action revises our existing definition of ``authentic native articles of handicrafts and clothing'' to reflect a December 28, 1992, Court ruling, which found that our regulation defining ``authentic native articles of handicrafts and clothing'' is inconsistent with the MMPA… …while its ``opinion should not be construed as authorizing a ``free-for-all'' killing of hundreds of sea otters,'' the Service ``does not have the authority to regulate the harvesting of sea otters for purposes of creating native handicrafts absent a finding of depletion.'' The Court also stated that the Service has the authority to take enforcement action against any takings that are wasteful. MAP HAACP Trainings in Naknek, September 19 & 20-22 Courses in Sanitation and Hazard Analysis and Critical Control Point (HACCP) will take place in Naknek in September. Both courses result in a certificate from the Association of Food and Drug Officials upon successful completion. The fee for the one-day Sanitation Control Procedures course on 9/19 is $45. The fee for the three-day HACCP course to be held 9/20-22 is $120. HACCP training is required by law for seafood processors. DEC seeks public comment on HB 19 Pesticide & applicator registration fees Comment deadline August 29 - $85 per registered pesticide, $25 per registered applicator In the 2004-2005 legislative session, the Alaska State Legislature enacted a new law that allows the Department of Environmental Conservation (DEC) to charge a fee for the registration of chemicals used in Alaska. In addition to a chemical registration fee, the law allows DEC to charge a fee to become a certified applicator as well. There are other aspects of this new legislation that will be addressed in future regulation packages… The purpose of this letter is to let you know that these regulations are now available for public comment…
